This month, we honor the career and impact of Myer J. Sankary, who recently retired after years of transformative service. His work laid the foundation for MCLA’s reputation as a premier provider of affordable civil mediation.

About Myer

Myer J. Sankary, Esq. has been a leader in Alternative Dispute Resolution for over four decades. Since beginning his mediation work in 1985, he has brought deep insight, compassion, and innovation to the field—drawing from both legal expertise and the cognitive sciences. A longtime member of the State Bar and San Fernando Valley Bar Association, Mr. Sankary helped shape MCLA into a trusted resource for accessible mediation.

What inspired you to become a mediator, or what inspired you to create MCLA?
I was drawn to alternative dispute resolution (ADR) because I felt I could get better results for my clients than by going to trial. Mediation was less stressful and more personally rewarding by helping people settle disputes and, on some occasions, restore broken relationships.

I went to my first training course in mediation at Pepperdine in 1996 and bonded with Peter Robinson on a training mission to the Oasis of Peace in Israel. As past president of SCMA, I was also inspired by the mediation community.

I was inspired to start MCLA in 2013 when the Court terminated its entire ADR program. Another mediator, Milan Slama, and I approached Adam Grant of the SFVBA to support the creation of a non-profit organization that would provide low-cost, high-quality mediators. Everything changed after we were awarded the contract with the LASC in 2018. Our mission was inspired by the tremendous need to fulfill the mission of the court—to provide access to justice and a speedy, efficient, cost-effective resolution. With the addition of Ben Root as Executive Director, we are spreading the word about the benefit of our services.

What do you believe are the best practices for preparing for a mediation session?
Carefully evaluate your case and develop a theme. Focus on your client’s needs. Lawyers should clearly explain both the benefits and risks of going to trial. There is a process for preparing for mediation which I call Mediation Advocacy. I am working on a 5-session program for lawyers to improve their mediation advocacy.

Settlement negotiations are not a one-off. It is a continuum. Lawyers should study negotiation strategies based on scientific research. They should insist on an early pre-mediation readiness conference to set forth an agenda and timeline.

How do you personally approach building trust and rapport?
It starts with my response in opening emails. I want parties to know I want to help resolve the dispute efficiently and fairly. Clients who select me often know my experience. I build trust by showing I understand the facts and law, and that I care about the emotional and personal stress involved. I share personal experiences to show empathy.

What values guide you?
I am committed to bringing all my skills and experience to assist the parties. My view is that it isn’t over until it’s over. I believe in applying the highest ethical standards, starting with “Do No Harm.”

What do you hope parties take away?
That I did the best job possible and was instrumental in getting the case settled, particularly when no one thought it could be.

How do you tailor your mediation style?
I apply different strategies depending on the parties. Some want a facilitative mediator; others want opinions and risk analysis. I build trust by showing I understand the unique rules and duties in probate court.
